1. Company Information

Sutton Atelier Vancouver (“we”, “our”, “us”) operates an online retail store offering fashion and lifestyle products shipped directly from our international suppliers to customers in Canada.

By accessing or purchasing from our website (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”).

2. Applicability

These Terms apply to all orders placed through our Site.
By placing an order, you acknowledge that you have read, understood, and accepted these Terms.

3. Products and Availability

All product descriptions, prices, and availability information are subject to change without notice.
Images are for illustrative purposes only. Slight variations in color or detail may occur due to lighting, photography, or manufacturer differences.

4. Prices, Import Duties, and Payments

- All prices are listed in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated.

- Payments must be made in full before shipment using one of the secure payment methods offered at checkout.

- Customers are responsible for all import duties, customs fees, and local taxes that may apply when the product enters Canada.

- These charges are not included in the product price or shipping fees and are collected by the carrier or customs authority upon delivery.

- Sutton Atelier Vancouver cannot predict or control these fees and is not liable for any such costs or delays caused by customs procedures.

5. Shipping and Delivery

- We ship directly from our international suppliers, primarily located in Asia.

- Average delivery time is 7–15 business days after order confirmation.

- Multiple items in one order may be shipped separately.

- Customs inspections may delay delivery. Sutton Atelier Vancouver is not responsible for any customs-related delays or charges.

- Risk of loss passes to you once the product is delivered to your shipping address.

6. Order Confirmation and Contract Formation

An order is considered accepted once you receive a confirmation email from us.
We reserve the right to refuse or cancel any order for reasons including, but not limited to, suspected fraud, stock unavailability, or incorrect pricing.

7. Returns and Refunds

We want you to be satisfied with your purchase.

- You may return unused and undamaged products within 30 days of receipt for a refund.

- Customers are responsible for return shipping costs unless the item is defective or incorrect.

- To initiate a return, contact us at info@suttonatelier.com for instructions.

- Refunds are processed to your original payment method once we receive and inspect the returned item.

- Items that are worn, washed, or damaged after delivery are not eligible for return.

- Personalized or intimate items (e.g. earrings, swimwear) are non-returnable for hygiene reasons.

8. Defective or Incorrect Items

If you receive a defective or wrong item, please notify us within 7 days of delivery with photos.
We will provide a replacement or refund at no additional cost.

9. Warranty

We comply with applicable consumer protection laws in Canada.
Unless otherwise stated, products come with a limited 30-day warranty against manufacturing defects.
This warranty does not cover normal wear and tear, misuse, or accidental damage.

10. Limitation of Liability

To the maximum extent permitted by law, Sutton Atelier Vancouver shall not be liable for:

- Any indirect, incidental, or consequential damages arising from the use or inability to use our products or website.

- Any customs fees, import duties, or local taxes imposed on shipments.

- Delays, losses, or damages caused by third parties (including carriers or customs authorities).

Our total liability shall never exceed the total amount paid for the specific product in question.

11. Force Majeure

We are not responsible for delays or failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, customs delays, strikes, pandemics, or transport disruptions.

12. Privacy and Data Protection

We handle personal information in accordance with our Privacy Policy.
We collect only the information necessary to process your order and improve customer experience.
By using our Site, you consent to our data practices under both the EU General Data Protection Regulation (GDPR) and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

13. Governing Law

However, Canadian consumer protection laws apply to all transactions made by customers residing in Canada.
Any dispute shall be submitted to the competent court in the Netherlands, unless mandatory law requires otherwise.
